Mumbai: On Thursday, the Gujarat High Court detained the Ahmedabad Municipal Corporation (AMC) for its recent campaign against food stalls selling non-vegetarian food in the city, as it warned that such actions should not be carried out to “satisfy the egos “of some people. However, the civic body said only restaurants that have encroached on public land face action.

“Today someone has a nightmare and tomorrow morning you will prevent people from selling everything. Do not do it under an impulse to satisfy the egos of some people,” said the bench of unique judges.

Judge Biren Vaishnav made the remarks while listening to a plea from 25 street vendors whose carts had recently been seized by the Corporation. Vendors included those who sold non-plant foods, eggs, and vegetables.

The court also warned the civic body that such actions should not be carried out under political pressure.

“… because the party in power says you don’t want to eat eggs, you want to stop them, you’re going to pick them up and take them away? Why are you doing that?” said the sole judge.

The civic body, however, said the campaign was not against restaurants that sell non-vegetarian food, but was aimed at eliminating illegal shops on the roads that were causing “obstacles to the public and traffic, or an outright blockade of pedestrians”.

“Petition filed under misconception because there is no impetus to remove all non-vegetarian carts. I have taken instructions. I am saying that encroachment on the roads, which is an obstacle to the public and traffic, or an absolute blockade of pedestrians “said the attorney representing the civic body said.

To this, Judge Vaishnav replied, “If there are encroachments, they must be abandoned. Welcome to act against encroachments. It is your power. But don’t confiscate simply because today someone says I don’t want something.”

At one point, Judge Vaishnav became nervous and asked the AMC, “What is your problem? How can you decide what to eat outside my home? How can you prevent people from eating whatever they want? Suddenly Because someone in power thinks this is what they want to do? ”

“If I have become sentimental, I withdraw it. Welcome acting on the usurpations. It is your power. But do not just confiscate because today in the morning someone says that I do not want something,” Judge Vaishnav said.

The lawyer responded, saying that “he can never be my lord.”

Judge Vaishnav later dismissed the petition.

Demands for the removal of non-vegetarian food carts from the roads have mainly come from local BJP leaders in different cities in Gujarat, but the state government has said that it has no problem with people’s different eating habits.

“Some people eat vegetarian food, some people eat non-vegetarian food, the BJP government has no problem with that. There have been demands to remove private ‘larries’ (carts) from the road.

“Our only concern is that the food sold in the food carts should not be unsanitary,” said Patel, addressing a BJP program in Bandhani village in Anand district.
